Frequently Asked Questions (FAQ)

Is there a return policy?   As most products are made to order; all purchases are considered final.

Are products guaranteed?  Understanding that production props undergo a certain level of abuse during the shoot life of a film; Props and Suits are guaranteed as specified in individual contractual agreement per the production.  Abnormal damage due to improper care are not within the guarantee.

Do you ship oversees and to P.O. boxes?  Yes, we will ship your package anywhere that accepts deliveries.  

Can suits be worn by anybody?  No, Character Suits are not Halloween costumes and are typically built to specific suit experienced actor(s) with applicable body type(s).

Are all items just for sale or can I rent?  Yes, some items (typically puppets, suits or props) have the possibility for rent, although – items made for specific acting talents, which would not fit anyone else, are typically not eligible for rental.

RIGHTS & PERMISSIONS

If I buy/rent a prop, or item what does that mean for my ownership or permission of use for that item?   This is a common topic of discussion amongst clients and artists no matter the media type.  In short, an artist retains the creative rights and license of any tangible work that he/she creates, even if an item is sold or rented for use to a production or individual, unless specific negotiations or rights are sold and/or relinquished in writing to a production or individual.

This extends and includes reproduction rights and/or further use of the likeness of the item for usages beyond the production itself.

Here’s an example: I buy a notable cartoon prop for the use as a prop in my movie. I can later sell this prop as a film used prop, as I own the item; but I cannot reproduce more of the cartoon likeness as I did not negotiate nor purchase reproduction rights, and I may not claim that the likeness of the prop belongs to me (even if I may have purchased a license or permission to use) the prop.

That said, clients may ask for prices as it pertains to the extended permissions, limited rights,  reproduction rights and/or ownership of full rights of a commission and/or requested item/prop.  **Note; unless contractually specified, purchased and signed, all rights of a creation is retained by Go2Effects and/or its authoring creator or creative team, and prices related to rights are not automatically included in the price quotes of the prop or creation of.

Are any rights included with rentals?  Only the right to use within the shoot window of the film.

What rights are included if I buy an item?  You own ‘what’ you hold – the prop, suit – the item. That’s it! You can use it for the purpose of the contract, sell it, auction it, etc., after you use it.. but that’s it.    *As ideas cannot be copyrighted by law; even items that were the conceptual idea of, and was communicated, provided and/or brainstormed with a production director/team, the creative interpretation is not automatically owned by the production it was intended but rather the creator of the item.

What is Reproduction Rights? The right to reproduce an item or likeness of a creation outside without the permission of the originating creator.

What is Limited rights?  Limited rights, the specifics, including quantity, time-duration, is a subject to the negotiation and agreement between the author and client per each item.

Example of a Limited Right:  The prop/suit is used in the film; the likeness of the prop/suit can be used in imagery specific to the promotion of the film prior and up until the release of the film (such as promotional film posters, trailers or DVD covers).

Rights (of any type) does not impact the ability for a production to create copies of the film (i.e., DVD) nor does it give Go2Effects or its creators any rights to the reproduction, profitability or distribution of the film.

What is Full Rights?  If a artist or creator agrees to, sells or relinquishes “signs over” in writing the full rights to a creation; this typically means that the purchaser now owns the ability to sell, negotiate terms of use, rights, and/or reproduction of an item or likeness.  Artist only retains the ownership of the fact that they created it as a Credit to.
